THIS USER AGREEMENT (THIS “AGREEMENT”) DESCRIBES THE TERMS ON WHICH BLUEFAUCET INC. (HEREINAFTER REFERRED TO AS “BFI” OR “COMPANY”) OFFERS YOU ACCESS AS AN USER/MERCHANT/SALES/EMPLOYEE ON WWW.BLUEFAUCET.COM AND ITS APP (“BLUEFAUCET”). BY PRESSING THE “SIGN IN” OR “SIGN UP” BUTTON, YOU ACCEPT THE TERMS AND CONDITIONS BELOW, AND YOU WILL BE GRANTED BIG END USER STATUS. YOU DECLINE OUR OFFER AND MAY NOT PARTICIPATE IN ANY ACTIVITY AS AN END USER/MERCHANT/SALES.
TERMS AND CONDITIONS:
“The Program” (“Program”) means the software, products, or services provided by BFI.
“BFI System” means the combination of client, merchants, and sales and database software that comprises the BLUEFAUCET network system.
“The Service” means the service and data platform on which BlueFaucet activities take place as provided by the Program and/or the BFI System.
In order to access the Service, you must (i) download BlueFaucet Program files, which we may make available for direct download online; (ii) have a valid account; and (iii) have an Internet connection (which we do not provide) to access the Service.
In addition to any fees described herein, you are responsible for paying all applicable taxes (including those we are not required to collect) and for all hardware, software, service, and other costs you incur to access the Service.
Both this Agreement and your BlueFaucet account entitle you to use the most updated version of the Program. We may update or otherwise enhance the Program at any time, and these updates will be available to you regardless of whether you are in the free trial period.
In the case of the free trial, you may access and use the Program subject to the terms and conditions of the Free Trial Program.
You agree to take primary responsibility for safeguarding access to your BlueFaucet account. For any losses or damages arising from your use of the Service, BFI’s liability is governed solely by the terms outlined in the “Limitation of Liability” section of this Agreement.
Additionally, you consent to receiving communications from BFI, including but not limited to newsletters, advertisements, promotional content, and other marketing activities within the Service.
When using the BFI System, you agree to:
BFI does not pre-screen communications or activities occurring over the system, as interactions often occur in real-time. However, BFI retains the right, as permitted by applicable law, to restrict or remove any content, communication, or behavior it deems inappropriate or in violation of the spirit of BlueFaucet. This includes, but is not limited to, termination of access for chat, promotional activities, or other interactions that are disruptive or abusive.
By using the BFI System, you acknowledge and accept that BFI’s enforcement decisions are final and binding. You further agree to indemnify BFI for any claims or damages resulting from your non-compliance with these rules.
Offer of Service: BlueFaucet is a subscription-based service application. Specifics regarding features and associated fees are outlined on the Pricing Page of the BlueFaucet website or application interface. BlueFaucet adheres to a strict no-refund policy.
Trial Offer: BlueFaucet provides a 30-day Free Trial program for new merchants (the “Trial Period”). During this period, merchants gain full access to BlueFaucet’s services except Employee Account service, including store-building features, promotion creation, and the ability to invite customers to join their membership, all at no cost.
Continuation Post-Trial: At the end of the Trial Period, if a merchant’s customer base does not exceed fifty (50) customers, the merchant will retain complimentary access to BlueFaucet’s services under the initial conditions provided.
Exceedance of Customer Limit: At the end of the Trial Period, if a merchant’s customer base exceeds fifty (50) customers, the merchant must transition to a paid subscription model to retain full-service functionality. Failure to comply will result in restricted access to customer information beyond the fifty (50) customer threshold. The determination of the fifty (50) customer limit will be based solely on the data at the conclusion of the Free Trial period. If the merchant opts not to become a paid subscriber, any customer data exceeding the fifty (50) customer threshold will be permanently revomved after Seven (7) days of the end of Free Trial and cannot be restored, even if the merchant renews their subscription later.
Subscription Cessation: If a merchant’s paid subscription terminates or lapses, access to customer information will be limited to the first fifty (50) customers. The same restrictions apply regardless of the reason for subscription cessation.
Program Updates: BlueFaucet reserves the right to modify or update the Free Trial Program at any time. Changes to the program, including duration, features, or eligibility, will be communicated through updates on the BlueFaucet website or application. Merchants are encouraged to review the terms periodically to stay informed about the latest conditions of the Free Trial Program.
Financial Commitments
Merchants utilizing BlueFaucet services are required to adhere to the payment schedules outlined in their service agreements. Failure to meet these financial obligations, including late or missed payments, may result in a reversion to the Free Trial Program. If reverted to the Free Trial Program, merchants will retain access only to the first fifty (50) customers recorded at the top of database. Customer data exceeding this threshold will be permanently removed and cannot be restored, even if the merchant later renews their subscription. Access to advanced features and functionalities will remain restricted until all payment obligations are fulfilled. Merchants are strongly encouraged to maintain a consistent subscription plan to avoid any loss of business or customers.
Data Retention and Deletion
If an account remains past due for more than seven (7) days, it will revert to the Free Trial Program. Upon reversion, any customer data exceeding the fifty (50) customer limit will be permanently deleted and cannot be restored, even if the subscription is later renewed.
Service Reinstatement
Merchants seeking to reinstate services following a suspension or termination due to non-payment must settle all outstanding balances and may be subject to a reinstatement fee. Please note that any customer data deleted during the period of suspension or termination CANNOT BE RESTORED, even if services are reinstated.
Termination
Either you or BFI may terminate this Agreement and the associated License at any time. To terminate, you must submit a termination request through the designated BFI system or support channels. Termination will take effect upon confirmation from BFI. Termination takes effect upon confirmation from BFI. No refunds will be provided for unused subscription periods, but access will continue until the current subscription term ends. Upon termination, your account will revert to the Free Trial Program unless you formally opt out. Data and access limitations will apply per the Free Trial Program terms.
THIRD PARTY PRODUCTS AND BFI SYSTEM.
BFI does not endorse, warrant, or guarantee any product or service offered through the BFI System by third parties or merchants. All products and services provided by third parties are the sole responsibility of those third parties. BFI is neither a party nor does it monitor any transactions conducted between you and third-party providers.
BFI expressly disclaims any liability for:
While BlueFaucet may provide assistance in helping you understand a situation or issue, it has no rights or authority to intervene in disputes or transactions between you and merchants or customers.
BFI is not responsible for ensuring that third-party products or services comply with applicable laws and regulations. Furthermore, BFI does not assume responsibility for any damages, losses, or inconveniences resulting from your interactions with third-party providers. It is your sole responsibility to exercise due diligence, verify information, and resolve any disputes directly with the merchant or customer involved.
As part of your access to the Service, you may upload content to our servers in various forms, including but not limited to products, pictures, prices, promotions, logos, information, and services (collectively, your “Content”).

In the event of copyright infringement claims, BFI adheres to the Digital Millennium Copyright Act (DMCA). Claims should be submitted to support@bluefaucet.com.
Merchants: The relationship between BlueFaucet and merchants is that of independent contractors. Merchants are solely responsible for their business operations, compliance with applicable laws, and interactions with customers. Nothing in this Agreement shall be construed to create a partnership, joint venture, agency, or employer-employee relationship between BlueFaucet and merchants. BlueFaucet provides tools and services to merchants but does not exercise control over their business practices.
Clients: The relationship between BlueFaucet and its customers is that of a service provider and client. Customers are granted access to the BlueFaucet platform and services in accordance with the terms of this Agreement. BlueFaucet is not responsible for disputes, claims, or interactions between customers and merchants using the platform. Such matters are solely between the involved parties.
Affiliate and Sales Referral Program Participants: Participants act as independent contractors. They are not employees, agents, or partners of BlueFaucet. As independent contractors, participants are responsible for their own taxes, expenses, compliance with applicable laws, and any liabilities arising from their activities. BlueFaucet provides guidelines and resources for their efforts but does not exercise direct control over how participants conduct their activities.
You may not use, modify, sub-license, rent, sell, assign, or transfer the license granted under this Agreement except as expressly provided herein. Any attempt to assign or transfer this Agreement or the License in violation of these terms is void. If any provision of this Agreement or the License is deemed unenforceable, that provision shall be adjusted only to the extent necessary to make it enforceable, without affecting the enforceability of any other provisions or the Agreement as a whole.
The paragraph headings in this Agreement are included for convenience only and do not limit or define the content of the provisions. BlueFaucet and you are independent contractors under this Agreement, and nothing in this Agreement shall be construed to establish any other relationship.
The failure of BlueFaucet to enforce any provision or right under this Agreement at any time does not constitute a waiver of that provision or right. Any waiver by BlueFaucet must be in writing to be effective and shall not constitute a waiver of any future obligation.
BlueFaucet is not responsible for delays or failures to perform resulting from circumstances beyond its reasonable control, including but not limited to acts of God, governmental actions, labor disputes, and interruptions in Internet services.
This Agreement is governed by the laws of the State of Washington, without regard to its conflict of law principles. The UN Convention on Contracts for the International Sale of Goods is expressly excluded. Any disputes arising under this Agreement shall be resolved exclusively in the state or federal courts located in Seattle, Washington. This Agreement constitutes the entire understanding between you and BlueFaucet regarding its subject matter and supersedes all prior agreements and understandings.
You acknowledge that you have read this Agreement, understand it, and agree to be bound by its terms and conditions. This Agreement represents the complete and exclusive statement of the agreements concerning the Program and the Service and supersedes all prior agreements between the parties.
