This Service Subscription Agreement (the “Agreement”) is entered into by and between BlueFaucet, Inc. (“BlueFaucet”), and the subscriber (“Customer”), and governs the terms and conditions of the Customer’s use of BlueFaucet’s services.

1. Free Trial Program

1.1 30-Day Free Trial: BlueFaucet offers a 30-day free trial period (“Free Trial”) during which the Customer can access and use the full functionality of BlueFaucet’s services. During this period, the Customer may:

• Invite new customers.
• Send coupons.
• Create promotions.
• Take orders and send receipts.

1.2 Limitations: The Free Trial does not include a complementary Employee Account.

2. Post-Trial Subscription Options

2.1 Membership Below 50 Customers: If, at the end of the Free Trial, the Customer has fewer than 50 customers in its membership database, the Customer may continue using BlueFaucet’s services free of charge.

2.2 Membership of 50 or More Customers:

• If the Customer’s membership database reaches or exceeds 50 customers by the end of the Free Trial, the Customer must select one of BlueFaucet’s Subscription Plans to continue accessing the full range of services.
• If the Customer chooses not to subscribe, BlueFaucet will only maintain services for the first 50 members in the Customer’s database, and any members beyond the 50th will not be retained.

3. Termination and Membership Retention

3.1 Termination of Subscription: If the Customer decides to terminate their BlueFaucet subscription at any point after the Free Trial, BlueFaucet will retain and continue to service the first 50 members in the Customer’s database. Any members beyond the 50th will be removed from BlueFaucet’s systems.

4. Additional Services and Charges

4.1 Extra Services: BlueFaucet may offer additional services that are not included in the standard Subscription Plans. These extra services will be provided at an additional charge.

4.2 Non-Refundable Charges: All charges for extra services are non-refundable.

5. Miscellaneous

5.1 Agreement to Terms: By using BlueFaucet’s services, the Customer agrees to the terms and conditions set forth in this Agreement.

5.2 Modification of Terms: BlueFaucet reserves the right to modify this Agreement at any time, with notice provided to the Customer. Continued use of the services after such modifications will constitute acceptance of the new terms.

5.3 Jurisdiction: This Agreement shall be governed by and construed in accordance with the laws of the State of Washington. Any disputes arising from this Agreement shall be subject to the exclusive jurisdiction of the courts located in Seattle, Washington.
